Terms of service
The owner of the online store community.renegadetea.com (hereinafter referred to as the Company) is OÜ Renegade Tea Artisans (registry code 14365627), located at Lodjapuu tee 8-1, Karla küla, Rae vald, Estonia.
Definitions
- „Company“ – OÜ Renegade Tea Artisans (registry code 14365627), located at Lodjapuu tee 8-1, Karla küla, Rae vald, Estonia.
- „Customer“ – Legal entity, participating in the Campaign.
- „Plantation“ – Land plot with the Georgian registry code 29.03.34.084, located in Tskaltubo municipality, Georgia.
- „Beehive“ – specific named and designated beehive together with the honeybee family.
- „Fee“ – a fee that Customer pays in order to participate in the Campaign
- „Harvest“ – the total amount of honey, produced by the Beehive during a given year.
- „Site“ – website https://community.renegadetea.com
- „NASP“ – The National Agency of State Property of Republic of Georgia
- The conditions of sale apply to purchases of goods and services made via the online store.
- By accepting these terms the Customer accepts also the terms brought out under each Product.
- The prices of products are indicated next to the products. All prices are in Euros.
- The Company reserves the right to change the used prices at any time. If a Customer has placed an order in the online store and has paid for it, then the Service Provider is obligated to deliver the products to the Customer with the prices valid at the moment the order was placed.
- LLC Renegade Tea (100% subsidiary of the Company), has entered into a long-term Rent Agreement (valid until Nov 2042) with the NASP for the Plantation.
- LLC Renegade Tea and Company have entered into an agreement where the Company will finance the purchase and installation of 20 beehives on the Plantation. In return, the Company will be able to buy honey, produced by those beehives with preferential terms and conditions.
- With this Campaign, the Company invites the interested parties to participate in the purchase and installation of the said beehives.
- In order to participate in the Campaign, the Customer will choose a specific beehive and will pay the applicable Fee that covers the purchase of the hive and all the required installation and improvement works during the 20-year period. After the payment of a Fee, the Customer will become the Sponsor of the chosen beehive.
- After receiving the Fee from the Customer, the Company will deliver the following services and goods in the framework of this Campaign:
- Install the sign with the name of the Customer on the beehive.
- Every year Customer has the right to receive 10% of the honey, produced by the adopted beehive.
- Customer does not pay for honey. The adoption fee also includes the shipping to the Customer's chosen address during the first 3 years (2023-2025). Starting from 2026 Customer has to pay for the actual shipping costs from the Company warehouse in Estonia to the Customer's address.
- In case it turns out during the first shipment, that sending honey to the Customer's residence country is not possible due to the customs or food safety regulations, Company will provide a full refund. If sending the honey becomes impossible due to the legislative changes during the subsequent years, it is a risk of the Customer.
- In order to receive the honey, the Customer has to place every year relevant order via www.renegadetea.com (e-shop operated by Company). This is required in order to ensure actual valid delivery information. Honey will be shipped once per year, after the end of the harvest season (usually in October) from the Company’s EU warehouse in Estonia.
- The company will provide the services as defined in p. 2.4. during the validity of the Rent Agreement for the Plantation but not less than 20 years (until 2042).
- In case the Rent Agreement for the Plantation is terminated before its term due to the fault or initiative of the Company, the Company has the right to transfer the Beehive to any other location deemed suitable for the Company.
- In case the Company is unable to provide the services as described in p.5 due to the Force Majeure or the fault of a third party, the Company will make an effort to continue providing the services to the Customer (for example by moving the beehives to a different region, etc.). However, should the Company be unable to provide an alternative location, or should the beekeeping become impossible altogether in Georgia (due to climate change or any other unforeseen factors), the Customer has no right to ask for a refund of the Fee.
Placing an order
- In order to participate in the Campaign, the Customer selects the desired available Beehive on the Site and ads it to the shopping basket. The Customer must fill in all of the required fields (first name, last name, e-mail, phone number, delivery address, postal code) to complete the order.
- It is possible to pay for the purchases with Paypal or with a credit card or through a bank link. It is also possible to pay with a bank transfer. In order to pay with a bank transfer Purchaser must contact Service Provider beforehand.
- The contract enters into force when the payable amount is transferred to the bank account of the Company.
- Customer agrees to provide current, complete and accurate information for all purchases made via the Site.
- After receiving the order, the Customer has the right to withdraw from the contract made with the Company within 14 calendar days.
- The right of withdrawal does not apply if the Customer is a corporation/juridical person.
- In order to withdraw from the Contract, the Customer must write to the e-mail address farmers@renegadetea.com within 14 calendar days of paying the Fee.
- When the Customer has exercised its right to withdraw from the Contract, the Company shall return the Fee to the Customer within 14 calendar days after receiving such notification. The money is returned to the same account, which was used for paying for the Fee.
Shipment
- The Customer bears that the shipping cost and the respective price information is displayed next to the shipping method.
- The shipping cost does not apply to the Beehive product itself and will be paid separately each year, starting from 2026 when placing the order for delivery of the tea (p.3.4.3).
- The shipment will be delivered by Omniva ( AS Eesti Post), Smartpost (Itella AS), and its relevant partners.
- Company retains the right to change the shipping partners at any time for any reason.
Direct Marketing and processing of personal data
- The Company only uses the personal data entered by the Customer (including name, phone number, address, e-mail and bank details) for processing the order, and purposes strictly needed to operate the Campaign.
- The Company is the controller of personal data of this online store.
- The Company shares the Customer data with its affiliated distribution- and marketing partner OÜ Renegade Tea Artisans for the purposes of operating the Campaign.
- The Company forwards personal data to the transport service providers in order to deliver the goods.
- The Company forwards personal data to Paypal in order to process the payment.
- The Company forwards personal data to the accounting company for accounting purposes.
- The Company sends newsletters and offers to the Customer's e-mail address only if the Customer has expressed their wish to receive them by entering their e-mail address on the website and indicating their desire to receive direct mail.
- The Customer is able to opt-out of offers and newsletters sent to their e-mail address at any time by letting the Company know via e-mail at farmers@renegadetea.com or by following the instructions in an e-mail containing an offer.
- Customer’s submission of personal information through the online store is governed by the Privacy Policy of the LTD Renegade Tea and its affiliated companies. The Privacy Policy can be found on the webpage at https://community.renegadetea.com/pages/dataprotectionrules
Disclaimer Of Liability
1. The Company shall not be responsible for and DISCLAIMS all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party (including your company), as a result of or which may be attributable, directly or indirectly, to your access and use of the website, any information contained on the website, your or your company's personal information or material and information transmitted over our system. In PARTICULAR, neither the Company nor any third party or data or content provider shall be liable in any way to you or to any other person, firm or corporation whatsoever for any loss, liability, damage (whether direct or consequential), personal injury or expense of any nature whatsoever arising from any delays, inaccuracies, errors in, or omission of any share price information or the transmission thereof, or for any actions taken in reliance thereon or occasioned thereby or by reason of non-performance or interruption, or termination thereof.
Miscellaneous Legal Provisions :
- Company may discontinue the Campaign at any time and for any reason, without notice.
- Company may change the contents, operation, or any and all other features of the Site at any time for any reason, without notice. Company may discontinue or restrict your use of the Site at any time for any reason, without notice.
- Nothing contained in this Agreement is in derogation of the Company's right to comply with governmental, court, and law enforcement requests or requirements relating to your use of this Site or information provided to or gathered by the Company with respect to such use.
Settlement of disputes
- All complaints made by Customer regarding the Company or Campaign must be sent to farmers@renegadetea.com.
- If the Customer and the Company are not able to settle the dispute by agreement, the Customer may contact the relevant consumer protection agencies.
Governing Law
- Those terms and conditions are governed by the law of the Republic of Estonia.
